1. Introduction

Welcome to the official website of Dianoche Pte. Ltd. These Terms and Conditions (“Terms”) govern your access to and use of our website, products and services, including online purchases.

By accessing or using our website or placing an order, you agree to be legally bound by these Terms.

2. Eligibility

By using this website, you confirm that you are at least 18 years old or are accessing the website under the supervision of a parent or legal guardian.

3. Product Information and Pricing

We aim to provide product descriptions, photographs, measurements and prices as accurately as reasonably possible. However, slight variations in gemstone colour, finish, appearance and other natural characteristics may occur.

Product colours may also appear differently depending on lighting, photography and screen settings. Images may be enlarged to show detail and may not represent the product’s actual size.

Prices are listed in Singapore Dollars (“SGD”) unless otherwise specified. Applicable taxes, shipping charges and international duties may be indicated during checkout.

We reserve the right to change our products or prices at any time without prior notice. If a product has been listed at an incorrect price, we may cancel the order and refund any payment already received.

4. Independent Reseller Status

Dianoche Pte. Ltd. is an independent reseller of new and pre-owned jewellery, gemstones, watches, luxury goods and related items.

Unless expressly stated otherwise, Dianoche is not affiliated with, authorised by, sponsored by or endorsed by any third-party designer, manufacturer or brand.

Any third-party brand names, trademarks and logos appearing on our website remain the property of their respective owners. They are used only where reasonably necessary to identify and describe products offered for sale.

5. Branded Items

Where an item is expressly described as branded, any statement regarding its brand, designer, maker, model, collection, provenance or authenticity is limited to the information provided in the relevant product listing and any accompanying certificate, report or documentation.

Unless expressly stated otherwise, Dianoche is not an authorised dealer, representative or service provider of the relevant brand.

Customers should carefully review the product listing and accompanying documentation to understand the nature and extent of any authentication or certification provided with the item.

6. Unbranded and Unsigned Items

Items described as “unbranded”, “unsigned” or without an identified maker are offered primarily based on their stated material characteristics. These may include:

• Precious-metal content or purity;
• Gemstone type and characteristics;
• Weight and measurements;
• Craftsmanship;
• Physical condition; and
• Any certificate or laboratory report expressly included with the item.

Because unbranded and unsigned items do not bear confirmed brand identification, Dianoche may be unable to determine their original designer, manufacturer, maker, model, collection, provenance or origin.

Unless expressly stated in the relevant product listing, Dianoche makes no representation or warranty regarding the original designer, manufacturer, maker, model, collection, provenance or origin of an unbranded or unsigned item.

Any resemblance between an unbranded or unsigned item and a product or design associated with a third party does not mean that the item was created, authorised, licensed or endorsed by that third party.

Dianoche does not knowingly offer counterfeit or infringing goods.

7. Pre-Owned Items and Condition

Pre-owned items may show signs of age, previous use, repair, alteration, restoration or ordinary wear.

Such items are sold in their existing condition, based on the product descriptions, photographs and any faults, limitations, repairs, alterations or signs of wear disclosed to the customer before purchase.

Where an item is described as being sold “as-is”, this means that the customer accepts its disclosed age, condition and characteristics. It does not exclude any consumer right or remedy that cannot lawfully be excluded under applicable Singapore law.

Customers are responsible for carefully reviewing the product description, photographs, measurements, certificates and disclosed condition before placing an order. Customers may contact Dianoche to request further information or arrange an inspection where reasonably available.

Dianoche shall not be responsible for a customer’s change of mind, ordinary wear consistent with the disclosed condition or any fault or limitation clearly disclosed before purchase, subject to applicable law.

8. Orders and Payment

All orders are subject to availability, payment confirmation and acceptance by Dianoche.

Full payment must be received before an order is processed unless alternative payment arrangements have been expressly agreed to in writing.

We accept secure payments through Stripe, Shopify Payments and other trusted payment gateways made available during checkout.

Dianoche reserves the right to refuse or cancel an order where reasonably necessary, including in cases of:

• Product unavailability;
• Incorrect product or pricing information;
• Unsuccessful payment verification;
• Suspected fraud or unauthorised activity; or
• Potential violation of applicable law or third-party rights.

If we cancel an order after receiving payment, the amount paid for the cancelled order will be refunded using the original payment method.

9. Shipping, Returns and Refunds

Please refer to our Shipping and Returns Policy for information regarding shipping, delivery, returns, exchanges and refunds.

Any restriction on returns or refunds does not exclude or limit any right or remedy available to a customer under applicable Singapore law.

10. Intellectual Property

Unless otherwise stated, all website content created by or licensed to Dianoche, including the Dianoche name, logos, branding, original text, graphics, photographs, videos and website layout, is owned by or licensed to Dianoche Pte. Ltd.

Such content may not be copied, reproduced, modified or distributed without our prior written consent.

Third-party trademarks, brand names, logos and product designs remain the property of their respective owners. Dianoche does not claim ownership of third-party intellectual property used solely to identify or describe products offered for sale.

11. Intellectual-Property Notice and Takedown Policy

Dianoche respects the intellectual-property rights of designers, brands and other rights holders.

If a rights holder or its authorised representative believes that an item or content appearing on our website infringes a registered design, trademark, copyright or other intellectual-property right, they may contact us at service@dianochediamonds.com.sg.

The notice should include:

• The rights holder’s name and contact information;
• Identification of the intellectual-property right concerned;
• Any applicable registration or reference number;
• The relevant product listing or website URL;
• An explanation of the alleged infringement;

We will promptly review sufficiently detailed notices. Where appropriate, we may temporarily suspend or remove the relevant listing while the matter is being reviewed.

We may request further information from the rights holder, supplier, seller or other relevant party before completing our review.

The submission or receipt of a notice does not constitute an admission of infringement, liability or wrongdoing by Dianoche.

12. User Conduct

By using this website, you agree not to:

• Engage in fraudulent, abusive, misleading or unlawful activity;
• Provide false or inaccurate information;
